Terms of Service

These Terms of Service ("Terms") govern your access to and use of Notice 21 (the "Service"), operated by Notice 21, LLC ("Notice 21," "we," "us," or "our"). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms.
1. The Service
Notice 21 provides a subscription-based aggregation of publicly available property records — including foreclosure, pre-foreclosure, real estate owned (REO), and tax lien filings — delivered via email digest and an online dashboard, scoped to the zip code(s) and search radius associated with your subscription. The Service may also include property owner contact information obtained through third-party data providers.
2. Accounts and Subscriptions
You must provide a valid email address to subscribe. Subscriptions are billed monthly in advance and automatically renew until canceled. You may cancel at any time through your account dashboard; cancellation takes effect at the end of your current billing period, and no partial refunds are issued for unused time within a billing period unless required by law.
3. Data Accuracy — No Warranty
Notice 21 aggregates data from public records and licensed third-party data providers. We do not independently verify the accuracy, completeness, or timeliness of any listing, valuation, equity estimate, deal score, or contact information provided through the Service. All data is provided "as is" without warranty of any kind. You are solely responsible for independently verifying any information before relying on it for financial, legal, or business decisions, including real estate transactions.
4. Contact Information and Responsible Use
Where the Service provides property owner phone numbers or email addresses, you are solely responsible for ensuring your use of that information complies with all applicable laws, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, applicable state do-not-call regulations, and any other consumer protection or privacy laws in the jurisdictions where you conduct outreach. Notice 21 does not authorize, encourage, or take responsibility for unlawful solicitation, harassment, or unsolicited communication made using data obtained through the Service.
5. Permitted Use
Your subscription grants you a personal, non-transferable license to access and use listing data for your own business purposes (e.g., evaluating potential real estate acquisitions). You may not resell, redistribute, sublicense, or provide bulk access to Service data to any third party without our prior written consent.
6. Fair Use of Listing Volume
Each market included in your subscription provides up to a stated number of fresh listings per month ("up to" a ceiling, not a guarantee — some markets may generate fewer qualifying records in a given month based on actual filing volume).
7. Termination
We may suspend or terminate your access to the Service for violation of these Terms, non-payment, or misuse of data obtained through the Service (including unlawful use of contact information). You may terminate your subscription at any time.
8. Limitation of Liability
To the fullest extent permitted by law, Notice 21 and its officers, employees, and data providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of or inability to use the Service, or reliance on any data provided through it. Our total liability for any claim relating to the Service is limited to the amount you paid us in the three (3) months preceding the claim.
9. Changes to the Service or Terms
We may modify these Terms or the Service at any time. Material changes will be communicated via email or an in-app notice. Continued use of the Service after changes take effect constitutes acceptance.
10. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
